Common ADA Errors and Omissions in New Construction and Alterations

This one-hour course lists a sampling of common accessibility errors or omissions that have been identified through the Department of Justice's ongoing enforcement efforts. The specific requirement of the Standards that has not been met follows each error/omission.  The list of errors/omissions provides examples of common deficiencies.

Learning Objectives

After completing this course you will have a better understanding of numerous common ADA errors and omissions as identified through the Department of Justice's ongoing enforcement efforts, as they relate to:
  • Parking – curb ramps, accessible routes and van-accessible parking spaces;
  • Exterior accessible routes – from public transportation stops, accessible parking spaces, passenger loading zones and public streets and sidewalks;
  • Ramps and Curb Ramps – landing areas where ramps change direction, curb ramps across circulation paths and handrails and edge protection;
  • Stairs – handrail extensions;
  • Doors – adequate maneuvering clearance at doors and accessible toilet stalls and the shape of door hardware;
  • Circulation Paths – protruding objects;
  • Toilet Rooms and Bathrooms – accessible toilet rooms and bathrooms, toilet rooms with six or more stalls, door swings and required clear floor space in accessible toilet rooms and transfer showers;
  • Signage – mounting location and height;
  • Visual Alarms – none installed although an audible alarm system is installed;
  • Drinking Fountains – mounting height;
  • Restaurants – food service queuing areas and condiment and utensil placement;
  • Transient Lodging – fold-down seats in roll-in showers, visual alarms missing from accessible rooms and clear opening width of doors in non-accessible rooms.

(Standards). ADA requirements for new construction and alterations include detailed provisions for elements, spaces, and facilities. Successful accessibility is often measured in inches, so attention to detail can make the difference between achieving access and excluding or injuring someone. When the ADA's minimum requirements are not met, the results can limit or exclude a person with a disability and can be dangerous.[1] State and local governments currently have the option to choose the Standards or the Uniform Federal Accessibility Standard (UFAS).
